Pursuant to the “Noncoal Surface Mining Conservation and Reclamation Act” and the “Clean Streams Law” notice is hereby given that IA Construction Corporation, PO Box 568, 24 Gibb Road, Franklin, PA 16323 has made application to the Pennsylvania Department of Environmental Protection (DEP) to revise existing surface noncoal mining permit #16030302 to include a request for a permit boundary correction to add 20.0 acres to the surface mine permit for extracting noncoal materials and for incidental coal extraction. The application includes a request for a variance to conduct surface mining activities within 100 feet of and extending up to the northeastern and southwestern right of way lines of a portion of PA Route 58 which are further described as follows: Beginning at the intersection of PA Route 58 and Ritts Station Road (S.R. 3011), then extending from aforesaid beginning point in a general southeast direction along the northeastern right of way line of PA Route 58 for approximately 1,600 feet. Beginning approximately 780 feet southeast of the intersection of PA Route 58 and Ritts Station Road (S.R. 3011), then extending from aforesaid beginning point in a general southeast direction along the southwestern right of way line of PA Route 58 for approximately 820 feet. The application includes a request for a variance to conduct surface mining activities within 100 feet of and extending up to the southeastern right of way line of a portion of Ritts Station Road (S.R. 3011) which is further described as follows: Beginning at the intersection of PA Route 58 and Ritts Station Road (S.R. 3011), then extending from aforesaid beginning point in a general northeast direction along the southeastern right of way line of Ritts Station Road (S.R. 3011) for approximately 1,350 feet to the eastern property line of IA Construction Corporation. These variances are for the purpose of conducting “surface mining activities” among which includes topsoil storage, the construction of erosion and sedimentation control facilities, treatment facilities, machinery repair, fuel storage, road culvert construction and/or reconstruction, blasting, overburden removal, overburden storage, limestone stockpiles, coal removal, and limestone removal. An earthen barrier will be constructed along the right of way, where necessary, to protect the public. The mine site is located in Richland and Licking Townships, Clarion County and is known as the Mascharka Mine. The permit area is 163.5 acres and is situated north and south of PA Route 58, east and west of Heeter Road (T-334), south of Ritts Station Road (S.R. 3011), northwest of Bell Road (S.R. 3020), approximately ½ mile southeast of Alum Rock on the lands of Larry D. Heasley, IA Construction Corporation, and Michelle R. Heeter. Receiving streams for the permit are unnamed tributaries to Turkey Run (HQ-CWF) and unnamed tributaries to the Clarion River (WWF).
